Your Local Workers’ Compensation Lawyers in Seattle

At The Walthew Law Firm, our workers’ comp attorneys understand the complex laws involved in workers’ compensation cases. In 80-plus years of representing injured workers, we have helped shape those very laws. Our focus has always been to protect the rights of injured workers in greater Seattle and western Washington, from Tacoma to Everett. We fight for our clients’ benefits, whether they file a claim for a specific back or neck injury, for occupational exposure causing pulmonary conditions, or overuse injuries involving wrist, knees, or shoulders. As Seattle, WA L&I attorneys, we act quickly to maximize their compensation benefits and secure treatment for their injuries or work disabilities.

We review all aspects of an individual’s claim to make certain the Department accepted all related conditions. We verify that time loss calculations are correct. For example, if you work more than one job at the time of an injury, the income from both jobs must be included in payment of time loss. Overtime, if worked regularly, must be included. Bonuses must be included. There are many variables to the calculation of wages that most people do not understand. If the Department or self-insured employer incorrectly calculates date-of-injury wages, time loss compensation could be underpaid for the life of the claim. This is just one reason to have your claim reviewed by a qualified workers’ compensation lawyer.

For more than 90 years, our attorneys have provided aggressive and dedicated advocacy for clients who are out of work following an accident. Do you need proper workers’ compensation benefits representation that is proactive, effective, and focused on the important issues? Far too much is at stake to retain the services of less experienced workers’ compensation lawyers. Contact The Walthew Law Firm at 206-483-1635.

Education About Workers’ Compensation Legal Rights

One option available to you is the choice of your own doctor. Workers’ compensation claims managers may suggest a physician of their choosing. However, you have the right to medical treatment from your own doctor as long as your doctor is part of the Department’s Provider Network. While you attend doctor appointments and therapy sessions or undergo needed surgery, we make sure you understand your rights and workers’ compensation coverage.

If you were hurt on the job and have specific questions or concerns about your legal rights or your legal options, please do not hesitate to contact our law firm for immediate assistance. We will be more than happy to answer your questions and provide reliable legal guidance.

Benefits Available Through a Workers’ Comp Claim in Washington

The overwhelming majority of employers in Washington are required to provide no-fault workers’ compensation insurance coverage to their employees. If you were hurt on the job, much needed medical and financial benefits may be available through your workers’ comp coverage. Specifically, this includes:

  • Coverage for all proper and necessary medical care until you reach maximum medical improvement (MMI); and
  • Time loss compensation, if you are temporarily unable to return to work on a full-time basis.

Additionally, if you sustained a permanent disability or impairment as a result of your injury, a monetary award (PPD – Permanent Partial Disability) should be paid to compensate you for your injured body part or your permanent impairment. If you can never return to work, you may be entitled to a permanent total disability claim (pension).   PPD and pension claims are highly complex — you should be represented by an experienced workers’ compensation attorney.

Social Security Disability Benefits While Receiving Workers’ Comp Benefits

In some cases, injured workers may be entitled to recover benefits through both a workers’ compensation claim and a Social Security Disability Insurance (SSDI) claim. Our Seattle, WA, workers’ compensation lawyers understand the impact Social Security disability benefits have on workers’ comp benefits.  If you are denied SSDI benefits, you should immediately contact an attorney who can help you.  We may be able to refer to you an attorney in your area to handle your Social Security denial.

When an injured worker is eligible to receive both L&I benefits and SSDI benefits, there are Federal and State offset laws in place that will limit the total recovery. Offset is complicated and our attorneys understand the implications for retroactive and ongoing benefits.  For structured settlements, it is imperative that any Washington workers’ comp settlement is written in the proper manner to allow you to recover full and fair Social Security disability benefits. Our law firm is here to help.

Our Lawyers Provide a Personalized Approach

As seasoned workers’s compensation benefits attorneys, we understand that there is no single best approach to a workers’ comp claim. Some clients return to their jobs. Others simply cannot handle the duties they once performed and require vocational retraining. Tragically, many workers suffer permanent disability, limiting their ability to work or ending their professional careers. We treat each workers’ compensation case with an individual personal approach because every situation is different.

Whether your work injuries entitle you to time loss compensation benefits while you recover or a lifetime pension if you cannot return to work, our lawyers can help.
